USCIS issues Final Guidance on When to File H-1B Amendments


On July 21, 2015, the United States Citizenship & Immigration Services (USCIS) issued a Policy Memorandum, PM-602-0120, providing final guidance on when an employer should file an amended H-1B petition after Matter of Simeio Solutions, LLC.   Readers will recall that USCIS issued its Draft Guidance on May 21, 2015.  We posted our comment on the Draft Guidance here.

USCIS noted that the Final Guidance “applies to and shall be used to guide determinations by all U.S. Citizenship and Immigration Services (USCIS) employees.”   This Policy is effective immediately.

H-4 EAD: Revised Form I-765 is Now Available


Applicants who are eligible to file Employment Authorization applications based on H-4 Visa eligibility may now use the United States Citizenship & Immigration Services’ (USCIS) revised Form I-765, Application for Employment Authorization.  The revised form has an edition date of 02/13/15.

Applicants should visit the USCIS forms page to download this revised Form I-765.  USCIS will accept the earlier version of the Form I-765, with an edition date of 05/27/2008.  However, it recommends H-4 EAD applicants to use the current version of the Form I-765 to avoid potential processing delays. USCIS Issues Guidance on When to File Amended H-1B Petitions


In an April 9, 2015 precedent decision in the Matter of Simieo Solutions, LLC (26 I&N Dec. 542 (AAO 2015)), the Administrative Appeals Office (AAO) held that a change in the place of employment of an H-1B worker requires an amended petition because a worksite change is a material change.   However, it was not clear whether an amended H-1B should be filed prior to the move; whether the H-1B employer should move the employee only upon approval of the amended H-1B petition; and importantly, what would happen where an employer obtained a new Labor Condition Application (LCA) for the new
